ArtistSafe Terms and Conditions

These Terms and Conditions set out the rules for using the ArtistSafe website, joining the ArtistSafe register, applying for ArtistSafe accreditation, participating in the ArtistSafe beta, and using any ArtistSafe services.

Please read these Terms carefully before using ArtistSafe. By using our website, submitting a form, joining the ArtistSafe register, applying for accreditation, purchasing accreditation, joining a beta list, or using any ArtistSafe service, you agree to these Terms.

If you do not agree to these Terms, you should not use ArtistSafe.

1. Who we are

ArtistSafe is a platform being developed to support fairer, more transparent and more secure transactions between artists, galleries, collectors and related art-sector professionals.

ArtistSafe may offer, now or in the future:

  • an artist register;

  • gallery fair practice accreditation;

  • an ArtistSafe accreditation badge or trust mark;

  • protected checkout or payment links;

  • payment splitting between artist, gallery and platform;

  • sales and payment reporting tools;

  • beta access to developing features;

  • resources, updates and related services.

2. Definitions

In these Terms:

“ArtistSafe”, “we”, “us” or “our” means ArtistSafe and/or the company operating ArtistSafe.

“User”, “you” or “your” means anyone who visits the website, submits a form, joins the register, applies for accreditation, purchases accreditation, joins the beta, or uses any ArtistSafe service.

“Artist” means an artist, maker or creative professional who joins or applies to join the ArtistSafe register.

“Gallery” means a gallery, art dealer, art consultancy, curator, art platform, interior professional or other business applying for or using ArtistSafe accreditation or services.

“Collector” means a person or organisation interested in purchasing or supporting artwork through ArtistSafe or its users.

“Accreditation” means ArtistSafe Fair Practice Accreditation or any related ArtistSafe badge, trust mark, listing, status or verification.

“Badge” means any ArtistSafe logo, digital badge, trust mark or accreditation mark that we permit a gallery or user to display.

“Services” means the website, register, accreditation, beta features, protected checkout, payment tools, dashboards, content, communications and any other ArtistSafe product or service.

3. About ArtistSafe

ArtistSafe is designed to encourage fair practice, clearer payment terms, transparent sales reporting and better protection for artists, galleries and collectors.

ArtistSafe is not currently a regulated financial institution, bank, legal adviser, accountant, art valuer, insurer, escrow provider or dispute resolution body.

Unless clearly stated otherwise, ArtistSafe does not:

  • act as an agent for artists, galleries or collectors;

  • guarantee the sale of artwork;

  • guarantee payment by any third party;

  • guarantee the authenticity, condition, value or provenance of artwork;

  • provide legal, financial, tax or professional advice;

  • replace written contracts between artists, galleries and collectors;

  • guarantee that an accredited gallery will always comply with all fair practice standards.

ArtistSafe provides tools, information, processes and signals of commitment. Users remain responsible for their own professional, legal, financial and contractual decisions.

4. Using the ArtistSafe website

You agree to use ArtistSafe lawfully and responsibly.

You must not:

  • misuse the website or services;

  • submit false, misleading or fraudulent information;

  • impersonate another person or organisation;

  • copy, scrape, reproduce or misuse ArtistSafe content, badges or branding;

  • interfere with the security or operation of the website;

  • upload malicious code, spam or harmful content;

  • use ArtistSafe in a way that damages our reputation or the reputation of other users.

We may suspend, restrict or remove access to ArtistSafe if we reasonably believe these Terms have been breached.

5. Artist register

Artists may be invited to join the ArtistSafe register by submitting information through an ArtistSafe form.

The artist register may initially be free to join.

By joining the register, you confirm that:

  • the information you provide is accurate and up to date;

  • you are the artist, or you have authority to submit information on behalf of the artist;

  • you are at least 18 years old;

  • you agree that ArtistSafe may contact you about the register, beta services, accreditation, protected checkout, payment tools or related ArtistSafe updates.

Joining the artist register does not guarantee:

  • sales;

  • representation;

  • inclusion in public listings;

  • access to all ArtistSafe services;

  • acceptance into protected checkout or payment beta features;

  • any particular outcome.

We may accept, reject, pause or remove artist registrations at our discretion, particularly where information appears inaccurate, incomplete, misleading or unsuitable for the purpose of ArtistSafe.

6. Gallery accreditation

Galleries and other eligible art-sector businesses may apply for ArtistSafe Fair Practice Accreditation.

Accreditation is intended to show a gallery’s commitment to fairer, clearer and more transparent practice. This may include, for example:

  • clear payment terms;

  • transparent commission arrangements;

  • timely artist payments;

  • accurate sales reporting;

  • professional communication;

  • respectful handling of artists’ work;

  • responsible conduct towards artists and collectors.

Accreditation does not mean that ArtistSafe guarantees, audits or permanently monitors every transaction or every business practice of an accredited gallery.

By applying for accreditation, you confirm that:

  • the information you provide is accurate and complete;

  • you have authority to apply on behalf of the gallery or organisation;

  • you intend to comply with ArtistSafe’s fair practice principles;

  • you will not use the ArtistSafe badge in a misleading way;

  • you will notify us if any information given in your application changes materially.

We may approve, reject, suspend, revoke or decline to renew accreditation at our discretion if we believe a gallery is not suitable, has provided misleading information, has misused the badge, has failed to uphold fair practice principles, or has acted in a way that may damage ArtistSafe’s reputation.

7. ArtistSafe badge and trust mark

If accreditation is approved, ArtistSafe may grant you a limited, non-exclusive, non-transferable, revocable licence to display the ArtistSafe badge on your website, emails, printed materials or other agreed locations.

You must only use the badge:

  • while your accreditation is active and paid for;

  • in the form provided or approved by ArtistSafe;

  • in connection with the accredited gallery, business or website;

  • in a way that is accurate and not misleading.

You must not:

  • alter the badge without permission;

  • use the badge after accreditation expires, is cancelled or is revoked;

  • suggest that ArtistSafe guarantees your business, artists, artworks, payments, sales or conduct;

  • transfer the badge to another person, website, gallery or organisation;

  • use the badge in a way that damages ArtistSafe or misleads artists, collectors or the public.

We may ask you to remove the badge at any time if we reasonably believe it is being misused.

8. Accreditation fees and payment

Accreditation may be offered for an annual fee, one-off fee, subscription fee or other price shown at the point of purchase.

The price, payment method, duration and renewal terms will be shown before you purchase.

Unless otherwise stated:

  • accreditation fees are payable in advance;

  • accreditation lasts for the period stated at purchase;

  • fees are for the review, administration, listing, badge licence and access to accreditation benefits;

  • payment does not guarantee approval if we later discover that the application is inaccurate, unsuitable or misleading.

If an application is rejected before accreditation is granted, we may refund the accreditation fee, less any clearly stated administration fee if applicable. If accreditation is suspended or revoked because of breach, misuse, inaccurate information or conduct concerns, we may not provide a refund.

9. Renewals and cancellation

If accreditation is sold as an annual product, it will last for 12 months unless stated otherwise.

If accreditation is set to renew automatically, this will be made clear before purchase. You will be told the renewal price, renewal date and how to cancel.

You may cancel future renewal by contacting us at [insert email] before the renewal date.

Cancellation of renewal does not automatically entitle you to a refund for the current accreditation period unless required by law or expressly stated at purchase.

If accreditation expires, is cancelled or is not renewed, you must stop using the ArtistSafe badge and remove it from your website and other materials.

10. Consumer cancellation rights

Some users may have consumer cancellation rights under UK law when buying online.

If you are purchasing as a consumer, you may have the right to cancel within 14 days of purchase, unless an exemption applies or you have requested immediate supply of a service or digital content and acknowledged that cancellation rights may be affected.

If you are purchasing as a business, gallery, trader or professional organisation, consumer cancellation rights may not apply.

11. Beta services

ArtistSafe may offer beta access to developing services, including but not limited to protected checkout, payment splitting, transaction dashboards, sales reporting, artist payment tools, gallery tools, collector tools or verification features.

Beta services are experimental and may be incomplete, interrupted, changed, withdrawn or discontinued at any time.

By joining or using a beta service, you understand that:

  • beta features may not work perfectly;

  • access may be limited or withdrawn;

  • features may change before public launch;

  • participation does not guarantee future access;

  • we may ask for feedback;

  • you must not rely on beta services as your sole system for legal, tax, accounting, payment or business records.

We are not liable for losses caused by reliance on beta features except where liability cannot legally be excluded.

12. Protected checkout and payment tools

ArtistSafe may introduce protected checkout, payment links, payment splitting or transaction tools.

Where these services are introduced, additional terms may apply. These may include terms from third-party payment processors, identity verification providers, fraud prevention services or banking infrastructure providers.

ArtistSafe may facilitate payment flows, but unless expressly stated otherwise:

  • we do not act as a bank;

  • we do not provide regulated financial advice;

  • we do not guarantee payment where a third-party payment provider fails, reverses or withholds funds;

  • we do not guarantee that a buyer, artist or gallery will fulfil their obligations;

  • we are not responsible for chargebacks, payment disputes, tax obligations, fraud, failed payments or incorrect details provided by users.

Users are responsible for checking payment details, commission arrangements, artist payment terms, delivery arrangements, refund terms, tax obligations and contractual obligations before entering into a transaction.

13. User responsibilities

You are responsible for:

  • providing accurate and current information;

  • keeping your login details secure, if accounts are introduced;

  • ensuring you have authority to act for any artist, gallery, business or organisation you represent;

  • complying with applicable laws, tax rules, consumer protection rules and professional obligations;

  • honouring any agreements you make with artists, galleries, collectors or other users;

  • ensuring that any artwork, listing, image or content you provide does not infringe third-party rights;

  • using ArtistSafe badges, wording and tools accurately and responsibly.

14. Artwork, sales and disputes

ArtistSafe is not automatically a party to contracts between artists, galleries and collectors unless we expressly agree otherwise in writing.

Artists, galleries and collectors remain responsible for agreeing and fulfilling terms relating to:

  • artwork price;

  • commission;

  • payment timing;

  • delivery;

  • insurance;

  • returns;

  • framing;

  • condition;

  • authenticity;

  • copyright;

  • VAT, tax and customs;

  • refunds or cancellations.

ArtistSafe may, at its discretion, try to assist with communication or provide general process support, but we are not required to resolve disputes and do not act as a court, arbitrator, mediator, solicitor or debt collection agency.

15. Content submitted to ArtistSafe

If you submit text, images, logos, artwork details, gallery information, artist statements, testimonials, reviews, website links or other content to ArtistSafe, you confirm that:

  • you have the right to submit it;

  • it is accurate and not misleading;

  • it does not infringe copyright, trade marks, privacy rights or other rights;

  • it is not unlawful, offensive, defamatory or harmful.

You grant ArtistSafe a non-exclusive, royalty-free licence to use, reproduce, display and publish submitted content for the purpose of operating, promoting and improving ArtistSafe, including displaying register entries, accreditation listings, case studies, website content, emails and social media posts.

You retain ownership of your own content.

We may edit, refuse, remove or decline to publish submitted content at our discretion.

16. Intellectual property

All ArtistSafe names, logos, badges, trust marks, website content, text, design, graphics, layouts, processes, documents and branding belong to ArtistSafe or its licensors unless stated otherwise.

You may not copy, reproduce, adapt, sell, licence, distribute or exploit ArtistSafe intellectual property without our written permission.

You may only use the ArtistSafe badge if we have granted you permission through active accreditation or another written agreement.

17. Accuracy of information

We aim to keep ArtistSafe information accurate and up to date, but we do not guarantee that all website content, listings, badge statuses, resources or service descriptions will always be complete, current or error-free.

We may update, change or remove content at any time.

Information on ArtistSafe is provided for general guidance only and should not be treated as legal, financial, tax, accounting, insurance or professional advice.

18. Third-party links and services

ArtistSafe may link to third-party websites, payment providers, forms, tools, galleries, artists, social media platforms or external services.

We are not responsible for third-party websites, content, policies, services, security, payment processes or conduct.

You should read the terms and privacy policies of any third-party service you use.

19. Privacy and data protection

We use personal information in accordance with our Privacy Policy.

By using ArtistSafe, submitting forms or using our services, you acknowledge that we may collect and process personal information as described in our Privacy Policy.

20. Cookies

21. Availability of ArtistSafe

We aim to keep ArtistSafe available, but we do not guarantee uninterrupted, secure or error-free access.

We may suspend, withdraw, update or change all or part of ArtistSafe at any time, including for maintenance, security, legal, operational or commercial reasons.

22. Limitation of liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so, including liability for death or personal injury caused by negligence, fraud, fraudulent misrepresentation, or any rights that cannot legally be excluded.

To the fullest extent permitted by law, ArtistSafe is not liable for:

  • indirect, consequential or special losses;

  • loss of profit, revenue, business, opportunity, goodwill or reputation;

  • loss caused by inaccurate information submitted by users;

  • disputes between artists, galleries, collectors or other third parties;

  • failed, delayed, reversed or disputed payments caused by third-party providers;

  • misuse of the ArtistSafe badge by users;

  • reliance on beta services;

  • website downtime, technical issues or data loss;

  • third-party websites, platforms, processors or services.

If ArtistSafe is found liable to you for any reason, our total liability will be limited to the amount you paid to ArtistSafe for the relevant service in the 12 months before the issue arose, unless the law requires otherwise.

23. Indemnity

If you are using ArtistSafe as a business, gallery, organisation or professional user, you agree to indemnify ArtistSafe against losses, claims, costs, damages, liabilities and expenses arising from:

  • your breach of these Terms;

  • inaccurate, misleading or unlawful information you provide;

  • misuse of ArtistSafe badges, branding or services;

  • disputes arising from your dealings with artists, galleries, collectors or third parties;

  • your breach of law, regulation or third-party rights.

24. Suspension and termination

We may suspend, restrict or terminate your access to ArtistSafe, remove your listing, revoke accreditation, or require removal of the ArtistSafe badge if:

  • you breach these Terms;

  • you provide false, incomplete or misleading information;

  • you misuse ArtistSafe branding or badges;

  • we receive credible complaints about your conduct;

  • you fail to pay applicable fees;

  • your use of ArtistSafe may harm users, third parties or ArtistSafe;

  • we are required to do so by law or a service provider.

You may stop using ArtistSafe at any time. If you wish to remove your register entry or accreditation listing, contact us at [insert email].

25. Changes to these Terms

We may update these Terms from time to time as ArtistSafe develops.

This may be necessary when we introduce new services, change our business model, add protected checkout, update accreditation, change payment processes, or need to comply with legal or operational requirements.

Continued use of ArtistSafe after changes are posted means you accept the updated Terms.

26. Governing law and jurisdiction

These Terms are governed by the laws of England and Wales.

The courts of England and Wales will have exclusive jurisdiction over any dispute arising from or relating to these Terms, unless consumer protection law gives you the right to bring proceedings elsewhere.
